I had a marijuana avatar and next thing i know i got temp banned. i didnt see anything about it in terms of use. if it has to do with legality and whatnot this is a game it shouldn't matter.

the ToS contain the following(highlighted the key part):

 

The following activities will result in the breach of this contract and also may carry additional civil and criminal liability:

First, bringing up a ban in the forums is unacceptable. If you wished to ask about this, contact Support.

 

Second, references to drugs or drug use will not be tolerated. Do not do it again. Evilbry has highlighted the correct part of the User Agreement to file this under.
